   TRADE MARK ORDINANCE


AntiDumping Duties Ordinance, 2000

to amend and consolidate the law relating to imposition of anti-dumping duties to offset such dumping

WHEREAS it is expedient to give effect in Pakistan to the provisions of Article VI of the General Agreement on Tariffs and Trade, 1994, and to the Agreement on Implementation thereof and to amend and consolidate the law relating to imposition of anti-dumping duties to offset such dumping, to provide a framework for investigation and determination of dumping and injury in respect of goods imported into Pakistan and for matters ancillary thereto or connected therewith;

AND WHEREAS the imposition of anti-dumping duties to offset injurious dumping is in the public interest;

AND WHEREAS the National Assembly and the Senate stand suspended in pursuance of the Proclamation of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999;

AND WHEREAS the President is satisfied that circumstances exist which render it necessary to take immediate action;

NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999, read with the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the President of the Islamic Republic of Pakistan is pleased to make and promulgate the following Ordinance:-

AntiDumping Duties Rules, 2001

NOTIFICATION

Short title and commencement.
1. These rules may be called the Anti-Dumping Duties Rules, 2001;

2. They shall come into force at once.

Definitions.

1. In these rules, unless there is anything repugnant in the subject or context;

i) “Application” means an application made under section 20 of the Ordinance;

ii) “Ordinance” means the Anti-Dumping Duties Ordinance, 2000 (LXV of 2000); and

iii) “Schedule” means the schedule to these rules.

2. All words and expressions used in these rules but not defined herein, shall have the meaning assigned to them in the Ordinance..

Countervailing Duties Ordinance, 2000

to amend and consolidate the law relating to imposition of countervailing duties to offset
subsidies

WHEREAS it is expedient and to give effect in Pakistan to the provisions of Articles VI and XVI of the General Agreement on Tariffs and Trade, 1994, and to the Agreement on Subsidies and Countervailing Measures and to amend and consolidate the law relating to imposition of countervailing duties to offset such subsidies, to provide a framework for investigation and determination of such subsidies and injury in respect of goods imported into Pakistan and matters ancillary thereto or connected therewith;

AND WHEREAS the imposition of countervailing duties to offset injurious subsidization is in the public interest;

Safeguards Ordinance, 2002

to provide for the imposition of safeguard measures

WHEREAS it is expedient and necessary to give effect in Pakistan to the provisions of Article XIX of the General Agreement on Tariffs and Trade, 1994, and to the Agreement on Safeguards to provide for the imposition of safeguard measures in accordance therewith, to provide a framework for investigation and determination of serious injury or threat of serious injury caused by products imported into Pakistan and for matters ancillary thereto or therewith;

AND WHEREAS the National Assembly and the Senate stand dissolved in pursuance of the Proclamation of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999 and Order No. 2 of 2001;

AND WHEREAS the President is satisfied that circumstances exist which render it necessary to take immediate action;
